Terms of Service

These Terms of Service govern your use of Theque. By creating an account or using the service, you agree to these terms. If you use Theque for an organization, you represent that you may accept these terms for that organization.
1. Accounts and eligibility
You must provide accurate account information, keep your credentials secure, and be legally able to enter this agreement. You are responsible for activity performed through your account and for promptly reporting suspected unauthorized access.
2. Customer content
You retain ownership of repositories, issues, comments, prompts, and other material you submit. You grant Theque the limited rights needed to store, process, transmit, back up, and display that content solely to operate, secure, support, and improve the service. You are responsible for having the rights required to submit your content.
3. AI-enabled features
When you choose an AI-enabled feature, the relevant prompts, source code, diffs, or context may be sent to the model provider identified by the product. AI output may be incomplete or wrong; you are responsible for reviewing it before relying on or publishing it. Do not submit material to an AI feature unless you are permitted to do so.
4. Acceptable use
You may not use Theque to:
- violate law, intellectual-property rights, privacy rights, or another person's rights;
- introduce malware, attack or evade security controls, or gain unauthorized access;
- abuse shared resources, disrupt other users, or conceal prohibited activity;
- use the service to build, distribute, or coordinate harmful or fraudulent activity; or
- resell access or impersonate another person without authorization.
5. Fees, taxes, and billing
Prices and metered charges are shown before use or in the applicable billing settings. You authorize us and our payment processor to charge amounts due, plus applicable taxes. Unless the law requires otherwise, charges for service already delivered are non-refundable. We will give reasonable notice before materially changing recurring prices.
6. Availability and changes
We work to keep Theque reliable, but do not promise uninterrupted or error-free operation. We may change, suspend, or discontinue features to maintain security, comply with law, or improve the service. Current service information is published on the status page.
7. Security and third-party services
Theque relies on infrastructure, payment, email, and optional AI providers. Their services may have separate terms. We use reasonable safeguards, but no online service can guarantee absolute security. You must maintain appropriate backups and controls for content whose loss would cause material harm.
8. Termination and suspension
You may stop using the service at any time. We may suspend or terminate access for non-payment, material breach, security risk, unlawful use, or harm to the service or others. Where practical, we will give notice and an opportunity to cure. Data access, export, retention, and deletion after termination are governed by the product's then-current controls and privacy notice.
9. Intellectual property and feedback
Theque and its software, branding, and documentation are protected by intellectual-property law. These terms do not transfer either party's ownership. If you provide feedback, you permit us to use it without restriction or compensation, without identifying you publicly.
10. Disclaimers and limitation of liability
To the fullest extent permitted by law, the service is provided “as is” and “as available,” without implied warranties. Theque is not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. Our aggregate liability arising from the service will not exceed the amount you paid Theque in the twelve months before the event giving rise to the claim. These limits do not apply where the law does not permit them.
11. Changes to these terms
We may update these terms. A new version will show a new effective date, and material changes will be communicated through the service or the account email when reasonably practicable. Continued use after the effective date means you accept the updated terms.

Questions about these terms may be sent to support@theque.sh. These terms are governed by the laws applicable where Theque's operator is established, without regard to conflict-of-law rules, except where consumer law requires another result.
